We comply with the Nigeria Data Protection Act (NDPA), GDPR, COPPA, and other applicable laws. These features may be limited by technical constraints, such as GPS accuracy or network availability. Parents remain responsible for all safety decisions involving their children.

The services, platforms, and content provided by VeriCortex are offered “as is” and “as available,” without warranties of any kind, either express or implied. We make no warranties:

  • That the services will meet your specific needs or expectations.
  • That services will be uninterrupted, timely, secure, or error-free.
  • Regarding the accuracy, reliability, or completeness of any content or data.

3.1 App-Specific Limitations: OmoSafe’s continuous monitoring features (e.g., geolocation) may increase battery consumption and require compatible devices (Android 10+ or iOS 14+). Users are responsible for maintaining device settings. No warranties apply except as required by applicable laws, such as Nigeria’s consumer protection regulations.

4. Limitation of Liability

4.1 Liability Scope: While we strive to provide reliable services, VeriCortex shall not be liable for indirect, incidental, or consequential damages, including those from technical inaccuracies in OmoSafe’s safety features, except in cases of gross negligence, willful misconduct, or where prohibited by law (e.g., NDPA). This applies to damages from:

  • Your use or inability to use our services.
  • Errors, omissions, or delays in content or services.
  • Third-party links, platforms, or content accessed through our Services.

5. Third-Party Content and Services

5.1 Third-Party Integrations: OmoSafe uses third-party services like Google Maps for geolocation and Firebase for notifications, vetted for child safety compliance. These services are subject to their own terms, and VeriCortex is not responsible for their content, privacy practices, or actions. Users assume risks of interacting with third-party services.

6. No Guarantee of Security or Outcomes

6.1 Security and Compliance: We implement robust security measures (e.g., AES-256 encryption) to protect child data but cannot guarantee absolute security against all threats. Compliance tools require user input and oversight to achieve certifications. Outcomes depend on proper configuration and use of our services.

7. Changes to This Notice

7.1 Notification of Updates: We notify users of significant updates via email, in-app alerts, or a website banner at least 14 days before they take effect. Previous versions are available at www.vericortex.com/notice-archive. Continued use after updates constitutes acceptance.

8. International Compliance

For users outside Nigeria, we comply with local laws, such as GDPR for EU residents and CCPA for California residents. Disclaimers and liability limitations are subject to applicable local regulations. Cross-border data handling for OmoSafe uses safeguards like standard contractual clauses.
