OmoSafe Parental Consent Policy

This Parental Consent Policy governs how VeriCortex Limited (“VeriCortex,” “we,” “our”) collects, uses, and protects personal data from children under 18 using the OmoSafe mobile application (“OmoSafe”), designed for parents, guardians, and authorized school administrators to monitor child safety in digital environments. We comply with the Nigeria Data Protection Act (NDPA), Children’s Online Privacy Protection Act (COPPA), GDPR, and other applicable laws. 1. Who Needs to Provide Consent

Use of OmoSafe for monitoring or protecting individuals under 18 requires verified parental or legal guardian consent. For institutional use (e.g., by schools), an authorized administrator must confirm the existence of proper consent procedures.

1.1 Institutional Consent: School administrators must maintain records of parental consent and comply with local education and privacy laws. VeriCortex may audit institutional consent processes to ensure compliance, reserving the right to suspend access if violations are found.


2. What Information We Collect

With consent, OmoSafe may collect:

  • Child’s device ID and device usage data.
  • Screen time activity and app access logs.
  • Location information (if enabled).
  • Alerts on unusual or restricted behavior.

We do not collect:

  • Content of private communications (e.g., SMS, calls, messages).
  • Personal identity information unless provided voluntarily by the parent or guardian.

2.1 Data Minimization and Retention: We collect only data necessary for OmoSafe’s safety features. Location data and alerts require explicit opt-in, while device ID and usage logs are mandatory for functionality. No sensitive data (e.g., biometrics, photos) is collected unless explicitly authorized. Data is retained only while the account is active and deleted within 30 days of deactivation, except as required by law.


3. How We Use the Information

We use this data solely to:

  • Provide child protection alerts and monitoring dashboards.
  • Enable screen time, location tracking, and content filtering controls.
  • Assist parents and schools in managing child safety.

3.1 Third-Party Sharing and Legal Requests: Data may be shared with third-party services (e.g., Google Maps for geolocation, Firebase/Supabase for notifications) that comply with child protection laws, only with parental consent. We may disclose data to law enforcement to protect child safety, notifying parents when legally permitted. Data use is strictly limited to providing safety features and parental controls. We do not sell, share, or use children’s data for advertising or profiling.


4. How Consent Is Obtained

4.1 Consent Verification: Parental consent is verified through methods such as email confirmation, payment verification, or two-factor authentication linked to the parent’s account. For international users, we ensure compliance with local laws, such as GDPR’s explicit consent requirements. Consent is documented and stored securely, with re-verification required for account changes or suspected unauthorized access. For institutional use, school administrators must reference internal parental consent documentation.


5. Withdrawing Consent

5.1 Withdrawal Process: Parents may withdraw consent via the app’s “Account Settings > Child Profile > Deactivate” menu or by emailing info@vericortex.com with the child’s account details. Withdrawal stops all data collection and monitoring immediately. Child data is deleted within 30 days, except as required by law.


6. Your Rights

6.1 Exercising Rights: Parents and guardians have the right to access, correct, delete, or transfer their child’s collected data via the app’s “Privacy Dashboard” or by emailing info@vericortex.com. For EU users, GDPR rights include data portability. Complaints can be filed with us or regulatory authorities, such as the Nigeria Data Protection Commission, as outlined at www.vericortex.com/complaints.


7. Data Security

7.1 Security Protocols: We use AES-256 encryption, secure APIs, role-based access controls, and regular security audits to protect child data. In case of a data breach, we notify affected parents within 72 hours, as required by law, and take immediate remedial actions.


8. Updates to This Policy

8.1 Notification of Updates: We notify parents of material changes via email, in-app alerts, or a website banner at least 14 days before they take effect. Previous policy versions are available at www.vericortex.com/policy-archive. Updates do not retroactively affect existing consent without re-verification.


9. International Compliance

For users outside Nigeria, we comply with local laws, such as GDPR for EU residents and CCPA for California residents. Consent is obtained explicitly where required, and cross-border data transfers use safeguards like standard contractual clauses.

11. Dispute Resolution

Disputes regarding this policy will be resolved through mediation in Lagos, Nigeria, before proceeding to arbitration or litigation in Nigerian courts.


12. Policy Enforcement

We enforce this policy through regular audits and compliance reviews. Unauthorized use or failure to maintain valid consent may result in account suspension or termination, with notification to the parent or administrator.


By registering and using OmoSafe with a minor, you confirm that you are the parent, legal guardian, or authorized school administrator of the child and consent to the data practices described in this policy.
